Burning is only allowed between the dates of October 1 and April 1 during the calendar year. Burning shall only be during daytime hours - NO BURNING IF WIND IS OVER 10 MPH. Area must be 50 FEET FROM ANY STRUCTURE & 25 FEET IF BURNING IS IN AN APPROVED BURNER. Burn site shall be competently attended by a competent person until fire is extinguished. This person shall have FIRE EXTINGUISHING EQUIPMENT readily available for use as deemed necessary by the fire official. The burn permit holder shall be responsible and liable for any damage caused or created by the fire and production of fire products and by- products that are emitted into the air. In addition the permit holder is responsible and liable for any reimbursements for any property loss or other damages from the fire. The Fire Chief of the Elsmere Fire Protection District or his designee may prohibit any or all open fires when natural conditions, the materials being used or local circumstances make such fires potentially hazardous or harmful. This permit complies with Elsmere City Ordinance #1193. Any person, firm, corporation, or agent thereof who violates any provision of the ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be fined not less than ten dollars ($10.00) nor more than fifty dollars ($50.00). Burning shall only be granted in accordance with regulations set by the Kentucky Standards of Safety, Kentucky Administrative Regulations (KAR), and the Guidelines for compliance with Kentucky Division for Air Quality Regulations. |
